A Swiss divorce judgment is valid in Switzerland, but for the Italian registers it must be transcribed. You need the final judgment with a certificate that it can no longer be appealed (passaggio in giudicato), the apostille, the translation into Italian and a request to the consulate or the municipality. The Geneva consulate states that Swiss judgments do not need delibazione (a separate recognition procedure before an Italian court).

How divorce works in Switzerland
You can divorce on a joint request, with an agreement on the effects of the divorce. With agreement on everything, the procedure usually takes three to four months. If one spouse does not agree, a separation of at least two years is generally required, except for serious reasons.
The competent court is the one at the place of domicile. The LDIP (the Swiss Federal Act on Private International Law) also allows the forum of the plaintiff who has lived in Switzerland for at least one year or is Swiss (art. 59). Swiss law applies to the divorce (art. 61).
The effects that matter
The judgment or the agreement can regulate support for the former spouse, child support, housing and occupational pension provision. Second-pillar funds accrued during the marriage are generally divided between the spouses. The duty to support children lasts until they come of age or finish an adequate education.
Recognition in Italy: the documents
- Final judgment that can no longer be appealed, in full copy. The Geneva consulate asks for the wording “Jugement définitif et exécutoire.” The Zurich consulate asks for the certificate of finality (Rechtskraftbescheinigung).
- Apostille affixed by the competent cantonal office. The apostille is the international stamp that certifies the authenticity of the document.
- Translation into Italian, following the consulate’s instructions: Geneva accepts only direct translations, with the translator’s signature legalized.
- Substitute declaration (dichiarazione sostitutiva, in Zurich): the judgment does not conflict with another final Italian judgment and no identical case is pending in Italy.
- Request for transcription to the competent consulate (Geneva for Geneva, Vaud and Valais; Zurich for its district) or to the Italian municipality where the marriage was celebrated or transcribed.
The conditions for recognizing foreign judgments are set by Italian law, and practice can vary from one office to another. Before submitting the request, check what the office that will receive it asks for.
Child support and spousal support
If the person who has to pay lives in a different country from the person who receives, you need to understand which decision is enforced and where. The rules depend on the international conventions in force between the countries involved, and they change over time. They must be checked case by case, before starting any action.
Frequent case · A problem that happens often
Two Italian spouses live in Basel. They divorce before the Swiss court. She goes back to live in Bari, he stays in Switzerland. In Italy, in the civil registry, they still appear as married. He pays child support in francs, with delays. To put marital status and payments in order, you need the transcription of the judgment and a way to enforce in Italy the amounts set by the Swiss judge.
Frequent case described in general terms: names, places and details do not refer to real people or cases.
The best solution for you
Before the judgment. The best path is an agreement on a joint request, which regulates support, children, housing and pension provision. It is usually worth it, because with agreement on everything the procedure takes three to four months.
After the judgment. You obtain the final judgment with the certificate of finality, the apostille and the translation. Then you ask for transcription from the consulate or the Italian municipality. It is usually best to start from the competent consulate.
If the former spouse does not pay or the office does not cooperate. You need to understand which decision is enforced and where. It is better to check with the consulate of your canton and to collect proof of the missed payments.
What to do right away
- Ask for the judgment in full copy with the certificate of finality.
- Have the apostille affixed and prepare the translation into Italian following the consulate’s instructions.
- Check with the competent consulate which procedure your case follows.
No path guarantees an outcome.
