- Anyone who suffers harm on vacation can claim compensation from whoever is responsible or from their insurer.
- You need evidence right away: photos, witnesses, medical records and contracts.
- The deadlines for taking action are limited: do not wait until you get home.
Who is liable for the harm
Anyone who causes harm through fault must compensate for it. The operator of a place or facility can also be held liable for harm resulting from stairs, floors or walkways in poor condition. For a beach club, a B&B or an agriturismo, the contract with the operator and the safety rules also matter.
Beach club and beach
The operator of a beach establishment must ensure the safety and maintenance of its facilities. In case of injury, immediately make a written report to the operator and ask for the name of the insurer. Collect the names of witnesses and photographs of the place.
B&B and accommodation facilities
A guest who falls on an unlit staircase or because of a faulty system can claim damages from the operator. However, you must prove the event and the harm. Keep the booking, receipts and messages: they prove the contract.
Rental car
The rental contract is often in Italian or English, with high deductibles and clauses on damage. Read carefully what the insurance covers and what it does not. At pick-up, photograph the car from every side. In case of an accident, fill in the joint accident report form and call the police or carabinieri if there are injuries. Do not sign documents you do not understand.
Where to sue
Which court has jurisdiction depends on the contract and the type of harm. Sometimes you can sue in your own country, other times before an Italian court. Ask an attorney before taking any step. General information is available on the Italian Ministry of Justice website.
Time limits and evidence
The right to compensation is lost if you wait too long. Before leaving, ask for a copy of your medical file and test results. For foreign documents a translator may be needed.
If the other side does not respond
If the operator or the rental company stays silent, write a letter by certified email (PEC) or registered mail: facts, damages and your request. Send a copy to the insurer, if you know who it is. Before accepting a sum, check that it covers all expenses and future consequences: a final release closes every other claim.
What to do in the first 7 days
- Photograph the place, the damage and the documents, with date and time.
- Write down the names and contact details of witnesses.
- Notify the operator or the rental company in writing.
- Get examined by a doctor and keep every medical report.
- Do not sign releases or waivers without understanding them.
Typical case
A problem that comes up often. Typical case described in general terms: names, places and details do not refer to real people or cases.
A tourist slips on a wet walkway at a beach club on the Gargano and breaks her wrist. The operator says it was carelessness. She goes home after three days without taking any names or photos.
