In 30 seconds
- Before work starts you need the right building permit and, in a protected area, the landscape authorization.
- With the contractor you sign a written contract that sets out the work, the schedule and staged payments.
- Many problems come from verbal agreements and from work started without permits.
The right permit
In Italy the type of filing depends on the work. An extension or a change of use is subject to different rules than a repair. For a trullo or masseria there is often also landscape protection: a special authorization may be needed and, if the property is a cultural asset, the opinion of the heritage authority (Soprintendenza). Ask the municipality’s technical office and the Puglia Region which filing is required, before you start. Work done without the right permit may be a building violation and can make the property hard to sell.
Who oversees the work
Appoint a technician you trust as site supervisor, someone other than the contractor. This person checks permits, measurements and quality. Those who live abroad need this even more, because they cannot see the site.
The contract with the contractor
The contract with the contractor is called an appalto. Put in the contract: a description of the work, materials, duration, penalties for delay, staged payments tied to the progress of the work, and who pays for changes and unforeseen costs. Pay by bank transfer and keep the invoices. Avoid large advance payments and verbal-only agreements: in a dispute they are hard to prove.
Defects and delays
If the work has defects, there are deadlines for reporting them to the contractor, and they can be short. Report everything in writing, with photos and dates, without waiting for the end of the work. Before stopping the site or withholding payments, get advice from an attorney: a wrong move can put you in the wrong.
Relations with your neighbors
In the countryside, relations with neighbors matter. Dry-stone walls, rights of way and boundaries are often handed down by word of mouth. Before touching a dry-stone wall or moving an access, talk to your neighbors and ask the municipality and the Region whether protection rules apply. Document the initial condition with dated photos. A written agreement signed by all the neighbors usually takes less time than a lawsuit.
Tax incentives and 1-euro houses
Building incentives and 1-euro house offers come with specific conditions and obligations. We do not give tax advice here. For taxes and incentives, contact a licensed professional or the Italian Revenue Agency (Agenzia delle Entrate). Read the call for applications on the municipality’s website carefully before signing any commitment.
Typical case
A problem that comes up often. Typical case described in general terms: names, places and details do not refer to real people or cases.
A foreign owner hires a local contractor to redo the roof of a masseria, with a verbal agreement and a cash advance. Halfway through, the contractor stops work. A few months later it emerges that the landscape authorization was missing.
Frequently asked questions
Can I start work before the permit?
No. You risk penalties and problems when you want to sell.
