In 30 seconds. When a person dies, the heirs do not automatically become heirs: they must accept the inheritance, and the choice can be made in three very different ways. Accepting “unconditionally” (pura e semplice) means answering for the debts with your own assets as well; accepting with benefit of inventory protects your personal assets; renouncing avoids both the assets and the debts. Getting a step or the timing wrong can be costly, and certain behavior counts as acceptance even if you did not intend it.
The three routes
- Unconditional acceptance, express or implied: the heir takes over everything, assets and debts. To understand when you accept without realizing it, see the guides “Implied acceptance of an inheritance: which behavior amounts to it” and “Filing the succession declaration is not acceptance”.
- Acceptance with benefit of inventory: debts are paid only out of the inherited assets. See “Acceptance with benefit of inventory: when it makes sense”; for minor children, “what happens at 18”.
- Renunciation: you lose everything, but also the debts. See “Renouncing an inheritance: how it is done and what to avoid”.
Before choosing
- How much time you have: how long you have to accept an inheritance, including for someone who is in possession of the deceased’s assets.
- What you can do in the meantime: the person called to the inheritance and the risks before acceptance.
- Debts and banks: the deceased’s debts to the bank and tax debts.
- Accounts and documents: releasing money held at the bank, and the vacant estate (eredità giacente).

How we follow your case
We start by analyzing the documents: who the heirs are, what assets and debts there are, and whether anyone has already done acts that may count as acceptance. Then the most prudent route is chosen and the necessary acts are handled, with a notary where required. The consultation takes place at the office or remotely, by video call, throughout Italy. We do not promise results: we assess the specific case.
