In 30 seconds
To transfer a home on the occasion of separation or divorce a written or verbal agreement is not enough: the right form is needed in order to transcribe it in the property registers. In court, incorporation by the judge may be enough; in assisted negotiation the signatures must be authenticated by a notary or other public official. The mortgage remains a separate problem: the bank is not bound by the agreement.
The home is almost always the most delicate point of a couple’s crisis. Who keeps it? Is it sold? Is the value divided? When the spouses agree to transfer it, getting the form wrong means finding yourself, years later, with a property that on paper has not changed. This guide explains the possible routes and the questions to ask before signing.
From the Firm’s practice
Before talking about transfer we always ask for the cadastral and mortgage search, the purchase deed and the mortgage contract. Many problems (cadastral discrepancies, mortgages, different shares) emerge only by reading these documents.
Legal and case-law references
Why form matters
In order to transcribe a deed in the property registers (and thus make it enforceable against third parties, art. 2643 c.c.) a title with the characteristics required by law is needed: a judgment, a public deed or a private agreement with authenticated signatures or signatures ascertained by a court (art. 2657 c.c.). An agreement signed only by the spouses, without the required forms, may have value between them but does not produce the effect that matters: registration in the registers.
- If it is not transcribed, the situation in the registers does not change.
- The creditors of the ex-spouse can still take action against the property registered in their name.
- In case of sale or death there may be disputes.
The possible routes

Request a consultationThe mortgage: the forgotten point
If the home is encumbered by a joint mortgage, the agreement between the spouses binds only them. The bank can continue to demand payment from both, even if the home goes to only one. To release the other the bank’s consent is needed (for example through an assumption of the debt or a substitution). Anyone who does not provide for this finds themselves liable for an asset they no longer own.
The family home and the children
If there are minor or non-self-sufficient children, the judge may assign the family home to the parent with whom the children live (art. 337-sexies c.c.), even if it is owned by the other. The assignment, if transcribed, is enforceable against third parties. This changes the value of the property and must be kept in mind if you are thinking of selling or transferring it.
Taxes and costs
Deeds relating to the proceedings for dissolution of the marriage and for separation enjoy, within the limits provided by law, exemptions from stamp duty, registration tax and other taxes (art. 19 of Law 74/1987). It is not certain that every transfer is covered, nor that notarial costs are exempt: this must be checked case by case with the notary and the lawyer.
Risks from creditors
Transfers concluded on the occasion of the marital crisis can be attacked by creditors with the clawback action (art. 2901 c.c.), if the prerequisites are shown. For this reason the transfer should be reasoned, balanced and documented.
What to bring to the first meeting
- Purchase deed and cadastral and mortgage search.
- Mortgage contract and latest instalments paid.
- Cadastral floor plan and planning documents.
- Any separation orders or agreements already signed.
- A clear idea of what you want to achieve: stay, sell, divide the value.
Frequently asked questions
Can I transfer the home with only a private agreement?
Between the spouses it may count as an agreement, but to transcribe a public deed, authenticated signatures or a judge’s order are needed.
Is a notary always needed?
Not always: in court the judge can incorporate the agreement. In assisted negotiation, however, to transcribe you need signatures authenticated by a notary or other public official.
Who pays the mortgage after separation?
Towards the bank the signatories of the mortgage remain liable, unless the bank consents to changes. Between the spouses it is possible to agree who pays and how.
Can the transfer be undone by creditors?
It may be the subject of a clawback action (art. 2901 c.c.) if the prerequisites are met.
Are there tax benefits?
Art. 19 of Law 74/1987 provides exemptions for the deeds of the proceedings, but the scope must be checked for each transfer.

The route that usually makes sense
The possible routes
- In court, with the transfer incorporated in the agreement.
- By notarial deed, also in coordination with the separation or divorce agreement.
- In assisted negotiation, with signatures authenticated by a notary or other public official.
Which one usually makes sense and why
The article indicates the notarial deed as the safest route: the notary checks ownership, mortgages, cadastral and planning conformity. In assisted negotiation the transfer is as a rule entrusted to the notary. In court the judge can incorporate the agreement, but correct declarations are nonetheless required. Before the mayor the transfer is not permitted.
What to do right away
- Gather the purchase deed, cadastral and mortgage search, floor plan.
- Obtain the mortgage contract and check whether the bank accepts changes.
- Decide what you want to achieve: stay, sell or divide the value.
- Agree with the lawyer and the notary on the sequence of the deeds before setting the signatures.
Every situation must be assessed on the documents of the specific case: this indication is not a promise of any outcome.
